Schedule 1 - Location specific information

Schedule 1.12 - Whangamata Harbour

In accordance with subclause 4.2.2 (Location specific schedules), any clauses contained in this schedule shall be read in conjunction with all other clauses in this bylaw.

Area covered:

This schedule applies to the waters of the Whangamata Harbour, as shown in Map 12.

Speed of vessels

S1.12.1 The provisions of 3.2.1 and 3.2.3 of the bylaw, which relate to speed in the vicinity of other vessels, persons or structures, have been replaced by S1.12.2 and S1.12.3 of this schedule, which provide similar restrictions but with varied distances.

This means that subject to subclauses S1.12.2 and S1.12.3, which relate to conditions specific to the Whangamata Harbour, the 5 knot speed limit referred to in subclauses 3.2.1 and 3.2.3 of this bylaw still applies to the Whangamata Harbour. For the avoidance of doubt, a breach of the conditions set out in subclauses S1.12.2 and S1.12.3, namely exceeding 5 knots in the Whangamata Harbour in circumstances which are in breach of the conditions of subclauses S1.12.2 and S1.12.3, shall constitute a breach of clause 3.2.

S1.12.2 No person shall, without reasonable excuse, propel or navigate a vessel (including a vessel towing someone or some object) at a proper speed exceeding 5 knots except for vessels in an access lane for towing of other persons or objects (as shown on Map 12):

  1. within the mooring zones as shown in Map 12; or
  2. within 50 metres of any other vessel, raft, or person in the water; or
  3. within either:
    1. 200 metres of the shore or of any other structure not already listed in this subclause; or
    2. on the inshore side of any row of buoys demarcating that distance from the shore or structure; except for vessels in the access lane for skiing or towing of other persons or objects; or
  4. within 200 metres of any vessel or raft that is flying Flag A of the International Code of Signals (diver’s flag); or
  5. within a 50 metre radius of any boat ramp or jetty.

S1.12.3 No person shall cause or allow himself or herself to be towed by a vessel (whether or not on a water ski, aquaplane, wakeboard or other similar object) at a proper speed exceeding 5 knots in any circumstances specified in any of paragraphs (a) to (e) of subclause S1.12.2.

Reserved areas

S1.12.4 Channel
In accordance with subclause 3.9.3 the channel as shown on Map 12 is reserved for the purpose of ensuring safety in crossing the bar at the entrance to the harbour, while sharing the zone with all due care to other operators.

Within this zone:

  1. Any surfboarders paddling out of the harbour and transiting through the main boating channel (as shown on Map 12) must comply with the general navigation rules for vessels as outlined in this bylaw.
  2. Any surfboarders commencing a ‘surfing run’ must be aware of other vessels in the vicinity.
  3. No surfboarder operating in this zone shall impede or obstruct any other vessel entering or departing from the zone.
  4. Any boat departing or entering the harbour entrance shall keep to the main channel and keep a proper lookout for any surfboarders.

S1.12.5 Surfing zone
In accordance with subclause 3.9.3 the surfing zone as shown on Map 12 is the predominant use, while sharing the zone with all due care to other operators.

Within this zone:

  1. Any surfboarders commencing a ‘surfing run’ must be aware of other vessels in the vicinity
  2. Any boat departing or entering the harbour entrance shall keep to the main channel and keep a proper lookout for any surfboarders.

S1.12.6 Prohibited power-driven vessels area
In accordance with subclause 3.9.3, the Moanaanuanu Estuary upstream from the Harry Watt Drive and Hetherington Road Bridge on the causeway as shown on Map 12, is reserved for the purpose of passive recreation. Therefore, in this area, unless otherwise specifically authorised by the harbourmaster, all power-driven vessels are prohibited.

S1.12.7 Access lane for towing
In accordance with subclause 3.9.3, the access lane for towing (as shown on Map 12) is reserved for the purpose of providing access for water skiing or the towing of other persons or objects from the beach. Subclauses 3.7.1 to 3.7.7 apply to this access lane.

Within this access lane:

  1. Vessels using this access lane shall give way to vessels entering or departing from the marina.
  2. Persons being towed shall ensure they swim on the most direct route back to shore if they are not being towed.

S1.12.8 Northern access channel
In accordance with subclause 3.9.3 the northern access channel as shown on Map 12, is for the predominant use of vessels transiting the northern access channel to or from the marina, slipway or boat ramp.

Within this channel:

  1. Vessels transiting through the northern access channel have right of way over vessels being used for towing persons or objects.

S1.12.9 Mooring zones
In accordance with subclause 3.9.3, the mooring zone is indicated on Map 12.

Within this zone:

  1. No person shall operate a vessel that is towing any person on water skis, a surfboard, or similar object, or who is barefoot skiing, or who is on a paraglider or similar object.
  2. Clause 2.8 shall apply to this zone.

Note: This mooring zone is indicative only. There shall be at least a 5 metre area remaining clear of moorings between the shore and the mooring zone. Placement and authorisation of moorings is controlled under the Resource Management Act 1991.
