In accordance with subclause 4.2.2 (Location specific schedules), any clauses contained in this schedule shall be read in conjunction with all other clauses in this bylaw.
Area covered
This schedule applies to the inland waters on the Waikato River known as Lake Arapuni as shown on Maps 19.1 to 19.2, and is separated into four activity-based zones.
General warnings
S1.19.1 Any operator using this lake must be aware that:
- The lake level can change without notice and may vary by up to 3.2 metres due to hydro operations. When Lake levels are low, care must be taken at all times to keep a watch out when entering and exiting boat ramps and for semi-submerged hazards (especially trees and rocks). - Subclause 3.10.1 d) of this bylaw states that no person shall operate any vessels (other than for maintenance purposes) within 200 metres of the Taupo gates and hydro dam structures on the Waikato River.
Speed of vessels
S1.19.2 The provisions of 3.2.1 and 3.2.3 of the bylaw, which relate to speed in the vicinity of other vessels, persons or structures, have been replaced by S1.19.3 and S1.19.4 of this schedule, which provide similar restrictions but with varied distances.
This means that subject to subclauses S1.19.3 and S1.19.4, which relate to conditions specific to Lake Arapuni, the 5 knot speed limit referred to in subclauses 3.2.1 and 3.2.3 of this bylaw still applies to Lake Arapuni. For the avoidance of doubt, a breach of the conditions set out in subclauses S1.19.3 and S1.19.4, namely exceeding 5 knots in Lake Arapuni in circumstances which are in breach of the conditions of subclauses S1.19.3 and S1.19.4, shall constitute a breach of clause 3.2.
S1.19.3 No person shall, without reasonable excuse, propel propel or navigate a vessel (including a vessel towing a person or an object) at a proper speed exceeding 5 knots:
- within 50 metres of any other vessel, raft or person in the water; or
- within 50 metres of any structure (excluding hydro dam structures as outlined in S1.19.1b); or
- within 30 metres of the edge of the water; or
- within 200 metres of any vessel or raft that is flying Flag A of the International Code of Signals (diver’s flag)
- within zone 1 or any access lanes as shown on Maps 19.1 to 19.2.
S1.19.4 No person shall cause or allow himself or herself to be towed by a vessel (whether or not on a water ski, aquaplane, wakeboard or other similar object) at a proper speed exceeding 5 knots in any circumstances specified in any of paragraphs (a) to (e) of subclause S1.19.3.
Reserved areas
S1. 19.5 5 knot zone
In accordance with subclause 3.9.3, the following areas as shown on Maps 19.1 to 19.2 (and including the area of Lake continuous between Map 19.1 and Map 19.2 to the dam) shall be reserved as 5 knot zones, for the purpose of providing for swimming, non-powered boating and other passive recreational activities:
- zone 1
- within 30 metres of the shore or bank of the lake or its tributaries (except those areas otherwise zoned as a access lane for towing).
Within these zones:
- No person shall propel or navigate a vessel at a proper speed greater than 5 knots.
- Any person operating a vessel within any 5 knot zone shall give way to swimmers or other non-powered craft at all times.
- No person shall cause any water ski, aquaplane or other similar object or person to be towed by any vessel.
- No person shall ride upon any water ski, aquaplane or other similar object being towed by any vessel.
S1.19.6 Access lanes
In accordance with subclause 3.9.3, the following areas as shown on Maps 19.1 to 19.2 shall be reserved as access lanes, for the purpose of providing access for vessels between the bank or shore and areas for general boating use:
- Bulmer’s Landing
- Jones’ Landing
- Arapuni Landing
- Landing Road Reserve (Anglers Cottage).
Within these zones:
- No person shall:
- cause any water ski, aquaplane or other similar object or person to be towed by any vessel
- ride upon any water ski, aquaplane or other similar object being towed by any vessel
- cause or permit any vessel to be moored or to be left unattended
- propel or navigate a vessel at a proper speed greater than 5 knots
- swim, dive or play in any access lane.
- Subclauses 3.7.1 to 3.7.7 of this bylaw apply.
S1.19.7 Access lanes for towing
In accordance with subclause 3.9.3, the following areas, as shown on Maps 19.1 and 19.2, shall be reserved as access lanes for towing, for the purpose of access by vessels towing a person or object from the bank or shore to the areas provided for general water skiing/towing of other persons or objects:
- Zone 3 – as shown on Maps 19.1 and 19.2
Within any access lane for towing:
- No person shall swim, dive or play in any access lane for towing, excluding any associated activity linked directly to water skiing or similar activities.
- Except for the circumstances listed in S1.19.3 and S1.19.4, any vessel may exceed 5 knots.
- No person shall commence water skiing or the towing of any aquaplane or similar object from, or alight or disembark from water skis, aquaplanes or similar objects onto the shore line of a lake, other than in the access lane for towing identified in this subclause.
- Subclauses 3.7.1 to 3.7.7 of this bylaw apply.
S1.19.8 Towing/active recreation zone
In accordance with subclause 3.9.3, the area marked as zone 3 and shown on Map 19.1 and continuing through the lake as a continuous area to the boundary south of Landing Road Reserve, as shown on Map 19.2, shall be reserved as a towing and active recreation zone, for the purpose of water skiing and other similar activities, personal water craft and other general boating activities.
Within the towing/active recreation zone:
- Any person engaged in water skiing or the towing of persons on aquaplanes or other similar objects shall at all times proceed in an anticlockwise direction and along the side of the lane or lake that lies on the starboard or right-hand side of the towing vessel.
- Except for the circumstances listed in S1.19.3 and S1.19.4, any vessel may exceed 5 knots.
- No person may swim, dive or play at a distance from shore greater than 30 metres.
S1.19.9 No towing zones
In accordance with subclause 3.9.3, the areas marked as zones 2 and 4 and shown on Map 19.1 to 19.2 through the lake as a continuous area to the dam in the south, shall be reserved as a no towing zone, to be used for the purpose of fishing and other passive recreation.
Within the no towing zones:
- Subclause S1.19.3(a) to (c) of this schedule applies.
- No person shall propel or navigate a vessel towing a person or object and no person shall cause or allow himself or herself to be towed by a vessel (whether or not on a water ski, aquaplane, wakeboard or other similar object).
