In accordance with subclause 4.2.2 (Location specific schedules), any clauses contained in this schedule shall be read in conjunction with all other clauses in this bylaw.
Area covered
This schedule applies to the waters of the Marokopa River from the source to the sea. The zones are shown on Map 3.
Speed of vessels
S1.3.1 The provisions of 3.2.1 and 3.2.3 of the bylaw, which relate to speed in the vicinity of other vessels, persons or structures, have been replaced by S1.3.2 and S1.3.3 of this schedule, which provide similar restrictions but with varied distances.
This means that subject to subclauses S1.3.2 and S1.3.3, which relate to conditions specific to the Marokopa River, the 5 knot speed limit referred to in subclauses 3.2.1 and 3.2.3 of this bylaw still applies to the Marokopa River. For the avoidance of doubt, a breach of the conditions set out in subclauses S1.3.2 and S1.3.3, namely exceeding 5 knots in the Marokopa River in circumstances which are in breach of the conditions of subclauses S1.3.2 and S1.3.3, shall constitute a breach of clause 3.2.
S1.3.2 No person shall, without reasonable excuse, propel or navigate a vessel (including a vessel towing someone or some object) at a proper speed exceeding 5 knots:
- within the 5 knot zone as shown on Map 3; or
- within 30 metres of any other vessel, raft, or person in the water; or
- within 30 metres of any other structure not already listed in this subclause; or
- within a 50 metre radius of any boat ramps; or
- within 200 metres of any vessel or raft that is flying Flag A of the International Code of Signals (diver’s flag).
S1.3.3 No person shall cause or allow himself or herself to be towed by a vessel (whether or not on a water ski, aquaplane, wakeboard or other similar object) at a proper speed exceeding 5 knots in any circumstances specified in any of paragraphs (a) to (e) of subclause S1.3.2.
Reserved areas
S1.3.4 Restricted activities zone
In accordance with subclause 3.9.3, the area 200 metres downstream from the Marae to 100 metres downstream of the rock (located in the middle of the narrow stretch of the river), as shown on Map 3, shall be reserved as a restricted activities zone. The sole purpose of this zone is to provide for access between the neighbouring zones. This zone is therefore restricted to the navigation of vessels through the zone in a safe manner and by the most direct route.
Within this zone:
- All vessels shall proceed through this zone in as direct a route as possible and speed shall be in accordance with subclause S1.3.2.
- No skipper shall use it or allow it to be used to tow any person (whether or not on a water ski or other similar object).
- No personal water craft shall be used in this zone unless for the purpose of accessing (in the most direct route) the open speed zone or the 5 knot zone.
S1.3.5 5 knot zone
In accordance with subclause 3.9.3, the area from 200 metres downstream of the boat ramp to 150 metres upstream of the boat ramp as shown on Map 3, is reserved as a 5 knot zone.
Within this zone:
- No person shall swim within a 10 metre radius of the boat ramp.
- No person shall dive within this zone.
- No person shall propel or navigate a vessel at a proper speed exceeding 5 knots.
S1.3.6 Open speed zone
In accordance with subclause 3.9.3, the following areas, as shown on Map 3, shall be reserved as open speed zones:
- from 100 metres downstream of the rock (located in the middle of the narrow stretch of the river) to the sea; and
- upstream from 150 metres upstream of the boat ramp.
Within this zone:
- Any vessel may pass through this zone and any personal water craft may use this zone provided they do not obstruct or impede any other vessel towing another person or object, or obstruct or impede any person being towed.
- All vessels towing another person or object shall move in an anticlockwise direction.
- Particular regard shall be had to clause 2.10.2 (Obstructions) of this bylaw.
