In accordance with subclause 4.2.2 (Location specific schedules), any clauses contained in this Schedule shall be read in conjunction with all other clauses in this bylaw.
Area covered
This schedule applies to the coastal waters of Whaingaroa (Raglan) Harbour and from Te Hara Point to Whale Bay, as shown in Map 6.
Speed of vessels
S1.6.1 The provisions of 3.2.1 and 3.2.3 of the bylaw, which relate to speed in the vicinity of other vessels, persons or structures, have been replaced by S1.6.2 and S1.6.3 of this schedule, which provide similar restrictions but with varied distances.
This means that subject to subclauses S1.6.2 and S1.6.3, which relate to conditions specific to the Whaingaroa (Raglan) Harbour, the 5 knot speed limit referred to in subclauses 3.2.1 and 3.2.3 of this bylaw still applies to the Whaingaroa (Raglan) Harbour. For the avoidance of doubt, a breach of the conditions set out in subclauses S1.6.2 and S1.6.3, namely exceeding 5 knots in the Whaingaroa (Raglan) Harbour in circumstances which are in breach of the conditions of subclauses S1.6.2 and S1.6.3, shall constitute a breach of clause 3.2.
S1.6.2 No person shall, without reasonable excuse, propel or navigate a vessel (including a vessel towing someone or some object) at a proper speed exceeding 5 knots:
- within the mooring zone as shown in Map 6; or
- within 50 metres of any other vessel, raft, or person in the water; or
- within either:
(i) 200 metres of the shore or of any other structure not already listed in this subclause; or
(ii) on the inshore side of any row of buoys demarcating that distance from the shore or structure; or
- within 200 metres of any vessel or raft that is flying Flag A of the International Code of Signals (diver’s flag); or
- within a 50 metre radius of any boat ramp or jetty.
S1.6.3 No person shall cause or allow himself or herself to be towed by a vessel (whether or not on a water ski, aquaplane, wakeboard or other similar object) at a proper speed exceeding 5 knots in any circumstances specified in any of paragraphs (a) to (e) of subclause S1.6.2.
Reserved areas
S1.6.4 Towing zones
In accordance with subclause 3.9.3, the following areas as shown on Map 6 shall be reserved as towing zones:
- east of Rangitoto Point
- from the eastern end of Wainamu Beach to 200 metres west of Putoetoe Point, and
- 600 metres north of Motukokako Point.
Within these zones:
- Any person may pass through these zones provided they do not obstruct or impede any other vessel towing another person or object, or obstruct or impede any person being towed.
- All vessels towing another person or object shall move in an anticlockwise direction.
S1.6.5 Personal water craft zones
In accordance with subclause 3.9.3, the areas from Te Hara Point to 700 metres north of Te Kaha Point, and from 500 metres south of Te Kaha Point to the northern side of the channel entrance, as shown on Map 6, are reserved as personal water craft zones. For the purpose of this subclause, the use of personal water craft is the predominant use in these zones.
Within these zones:
- No person shall use a surfboard.
- No person shall dive within this zone.
S1.6.6 Surfing zones
In accordance with subclause 3.9.3, the following areas as shown on Map 6 are reserved as surfing zones:
- from 700 metres north of Te Kaha Point to 500 metres south of Te Kaha Point
- 1.5 kilometres south along Ngarunui Beach and
- from Manu Bay to 500 metres west of Whale Bay.
For the purpose of this subclause, surfing is the predominant use in these zones.
Within these zones:
- No person shall use a personal water craft unless for the sole purpose of towing surfers or for lifesaving. In the event of any safety issues arising the harbourmaster may stop use of any such personal water craft in these zones.
- No person shall use a surfboard in any area flagged for surf lifesaving purposes.
S1.6.7 Prohibited personal water craft zone
In accordance with subclause 3.9.3, the following areas as shown on Map 6 are reserved for the purpose of ensuring safety in a small channel:
- from Putoetoe Point east past Tokatara rocks to Bridal Creek and out to 200 metres
- all waterways from Putoetoe Point upstream of Opotoru Estuary, including Wainui Stream.
Within these zones:
- All personal water craft are prohibited, unless authorised in writing by the harbourmaster.
- Any person may access a boat ramp to launch or retrieve their personal water craft within this zone but must travel at a speed no greater than 5 knots until they are outside the zone.
S1.6.8 Mooring zone
In accordance with subclause 3.9.3, the Whaingaroa (Raglan) Harbour mooring zone is shown on Map 6.
Within this zone:
- No person shall operate a vessel that is towing any person on water skis, a surfboard, or similar object, or who is barefoot skiing, or who is on a paraglider or similar object.
- Clause 2.8 shall apply to these zones.
Note: This mooring zone is indicative only. There shall be at least a 5 metre area remaining clear of moorings between the shore and any moorings. Placement and authorisation of moorings is controlled under the Resource Management Act 1991.
S1.6.9 Bar transit zone
In accordance with subclause 3.9.3 the transit zone at the mouth of the Whaingaroa (Raglan) Harbour, out to the 10 metre mark, as shown on hydrographical chart NZ4421 and as shown on Map 6, is reserved for the purpose of ensuring safety in crossing the bar at the entrance to the harbour.
Within this zone:
- No person shall swim in the vicinity of the bar at the harbour entrance, at the north-eastern end of Ngarunui Beach.
- The priority use for this area is a transit area for vessels entering or departing the harbour and it is recognised that boats may approach this area at speed in excess of 5 knots
- Any other users in this area must not obstruct or impede any vessel that is transiting through the zone.
- All power driven vessels transiting the area must maintain their course. No kite surfers or board sailors operating in this area shall obstruct or impede the path of any transiting vessel.
S1.6.10 Manu Bay transit zone
In accordance with subclause 3.9.3 the transit zone at Manu Bay as shown on Map 6 is reserved for the purpose of ensuring safety in entering and departing the boat ramp.
Within this zone:
- Any other users in this area must not obstruct or impede any vessel that is transiting through the zone to or from Manu Bay.
- The priority use for this area is a transit area for vessels entering and departing the boat ramp.
S1.6.11 Access lane for towing
In accordance with subclause 3.9.3 the access lane for towing at Moonlight Bay out to 200 metres from the shore as shown on Map 6 is reserved for the purpose of providing access for water skiing or the towing of other persons or objects from the beach. Subclauses 3.7.1 to 3.7.7 apply to these access lanes.
Within this zone:
- Any person engaged in water skiing or the towing of persons on aquaplanes or other similar objects shall at all times proceed in an anticlockwise direction and along the side of the lane that lies on the starboard or right hand side of the towing vessel.
